Terms of use
The short version: the app is yours to use, the journal is yours to keep, and because it never leaves your devices, keeping it safe is in your hands. We promise to be straight with you and ask for nothing more than fair use.
Who you are agreeing with
These terms are between you and Flag Finder (Pty) Ltd, a company registered in South Africa (“we”). By installing or using Memorious you accept them. If you do not, don’t use the app.
Your licence
When you buy the Memorious app for iPhone through Apple’s App Store, we grant you a personal, non-transferable licence to use it on devices you own or control, under Apple’s standard terms for apps sold on the App Store. The desktop and web versions are open source; the engine is available under the MIT or Apache-2.0 licence at github.com/ponelat/memorious, and that licence governs that code.
“Memorious” and its wordmark are ours. The licence above does not let you use them to describe something else.
Your journal is yours
Everything you put into Memorious stays your property. We claim no rights over it, never see it, and never use it. See the privacy policy for what that means in practice.
What you are responsible for
- Your master password. It is the only key to your journal. We cannot reset or recover it. Lose it and the journal is unreadable, permanently.
- Your backups. Your journal exists only on the devices you pair. If every one of them is lost, wiped or broken, the journal is gone. Pairing a second device, or running your own always-on peer, is the backup.
- Your devices and network. Keeping them updated and secure is up to you.
- What you record. You must have the right to record, photograph or store what you capture, including other people. Some places require consent to record a conversation; that law is yours to follow.
Fair use
Don’t use Memorious to break the law, to harm anyone, or to attack the relay and lookup services that help your devices find each other. Don’t try to defeat the licensing of the paid app. That is the whole list.
Updates and availability
We update the app when we can and may change or remove features. The app has no server of ours, so it keeps working whether or not we do; the optional relay and address-lookup services are run by third parties and may change or become unavailable, in which case direct connections still work.
No warranty, and a limit on liability
Memorious is provided as it is. We do not promise it is free of defects or that it will suit your purpose. To the fullest extent the law allows, we are not liable for any loss of data, loss of profit, or indirect or consequential loss arising from the app, and our total liability to you is limited to the amount you paid for it. Nothing here limits rights you have under South Africa’s Consumer Protection Act or other law that cannot be excluded.
Ending things
You can stop using Memorious at any time by deleting the app; your journal stays on your other devices. We may end your licence if you break these terms. Refunds for the App Store purchase are handled by Apple under Apple’s policies.
Law and disputes
These terms are governed by the law of South Africa. If we disagree about something, write to us first; most things are solved by an email. Otherwise the courts of South Africa have jurisdiction.
Changes to these terms
If these terms change, the new version is published here with a new effective date. Continued use after that date means you accept them.
